Utility models are one of the three ways in which we can patent industrial inventions. The other two ways, besides the utility model, are patents and trade secrets.

Utility models are protected for ten years in Spain, with the first year having international priority.

Utility models allow the patenting of ideas on tools, simple products and thanks to the new Patent Law it also allows the patenting of compositions.

Utility models emerged in Germany around 1870, and exist in about a hundred countries, such as Spain, Russia, France or Japan.

Who can apply for a utility model?
A utility model can be applied for by a natural or legal person, and also by public entities.
The same utility model can have several applicants, as long as the sum of the percentage of each of these applicants is 100%.

If several people come up with the same idea, the utility model will belong to the person who first applies for it, hence the importance of not leaving the protection for too long.
