A judge who refused to back down - Justice George Seah SCJ: [GKtv’s Hall of Fame-Ep-3]

When I first met Datuk George Seah SCJ, he was no longer a judge of the Supreme Court. He had been dismissed by a tribunal set up by the PM Mahathir, which resulted in the 1988 Judicial Crisis.

This is the judge who refused to back down in the face of an arbitrary Executive order. And he, by an injunction, ordered the tribunal hearing the Tun Salleh Abas case to stop their hearing. The Supreme Court order was delivered to Parliament's gates, which were shut fast. A message was relayed to the Supreme Court; and it was brought to George Seah SCJ's attention.

He called Parliament, and told officials there that a refusal to deliver the order would be considered a contempt of court. The gates swung open; but Seah's fate was sealed.

Mahathir convened a second tribunal, and threw him out of the judiciary on charges of 'judicial misconduct'; a move that earned Mahathir the wrath of the world; and the shadows of which dog him to this day.

Seah SCJ called it, 'charged or misconduct for doing the right thing'. And 'so be it', he said, and retired to a life of quiet dignity.

In his May 2005 article entitled ‘The Hidden Story’, he says, ‘History will exonerate me for taking a stand’.

He continues:

‘History will be the judge whether I was guilty of misbehaviour as charged for faithfully discharging the functions of a Judge of the Supreme Court of Malaysia conscientiously and with the highest regard for the preservation of an independent Judiciary.'

'During critical and crucial times in the history of a nation, judges are expected to be the standard-bearers of justice. This is a moral obligation and [judges] are expected to act … with a clear conscience.'

He said:

'The five of us who were embroiled in this difficult episode of the 1988 judicial crisis did not rally around the suspended LP but rather responded to the call of duty in the interest of justice.

No matter how facts are twisted, in the eyes of God, Truth will prevail from the 1988 Judicial Crisis.’

Cutting through the swirling mists of time, these words fall upon us as would a sunbeam.
