The Pact Act of 2022 made several changes to the way in which Veterans' Affairs will handle presumptive conditions. In the past, the VA would only consider a service-connected disability if it was directly related to an injury or event that occurred during active military service. However, under the new Pact Act, the VA will now also presume that certain conditions are service-connected if they are commonly seen in veterans of a particular era or conflict.

This is a huge shift for the VA, and it means that many more veterans will now be eligible for veterans benefits. The most significant change is that the VA will now presume that any condition that is listed as a "presumptive condition" is service-connected. This includes conditions such as cancer, heart disease, and Parkinson's disease.

The Pact Act also allows for the VA to consider "supplemental claims" when determining service-connection. This means that if a veteran has a condition that is not currently listed as a presumptive condition, but it is later determined to be commonly seen in veterans of a particular era or conflict, the VA can retroactively grant service-connection.

This is all good news for veterans, as it will make it easier to get the benefits they deserve. However, there are still some roadblocks in place. For one, the Pact Act only applies to conditions that are diagnosed after the date of enactment (January 1st, 2023). So, if you are already receiving benefits for a condition that is not currently listed as a presumptive condition, you will not be automatically granted supplemental benefits.
