This is a lick over one bar of Em (iii) → A7 (VI7), but if interpreted as the E Phrygian scale, two avoid notes (♭9 and ♭13) come into play. However, if interpreted as C Ionian, there’s only one avoid note (the 11th), and even that is used as a passing tone. Therefore, I interpreted it as playing the C Ionian scale over Em (iii).
